These Terms and Conditions (“Terms”) govern the use of Lumina’s eSIM products, services, applications, and related offerings (“Services”). By purchasing, activating, or using Lumina Services, you agree to these Terms. Please read them carefully.
1. Definitions
- “Lumina,” “we,” “our,” or “us” refers to the company Lumina and its affiliates or authorized distributors.
- “You,” “your,” or “Customer” refers to the individual or entity purchasing or using our Services.
- “eSIM” means the embedded SIM technology that enables cellular connectivity without a physical SIM card.
- “Network Partners” means the third-party carriers and mobile networks that provide connectivity under Lumina’s Services.
2. Eligibility
- You must be at least 13 years old or the age of majority in your jurisdiction to use Lumina Services.
- By using the Services, you represent that you have the legal authority to enter into this agreement.
3. Services
- Lumina provides eSIM-based mobile data and connectivity services through its Network Partners.
- Coverage, speed, and quality of service may vary depending on location, device compatibility, network availability, and other factors beyond Lumina’s control.
4. Account and Registration
- To use our Services, you may need to create an account and provide accurate, current, and complete information.
- You are responsible for maintaining the confidentiality of your account credentials and are liable for activities performed under your account.
5. Plans, Pricing, and Payments
- Lumina may offer prepaid packages, pay-as-you-go, or subscription-based eSIM plans.
- Prices, fees, and available plans are disclosed at the time of purchase and may vary by country.
- All payments must be made in the currency indicated and through approved payment methods.
- Taxes, fees, and surcharges may apply and are your responsibility.
- Lumina reserves the right to change pricing or Service features, with prior reasonable notice where required by law.
6. Activation and Expiry
- eSIM profiles are activated digitally after purchase, subject to device compatibility.
- Certain plans may have validity periods, data caps, or usage limits. Once expired or exhausted no refunds will be issued.
- eSIMs are non-transferable and cannot be reused across multiple devices unless specifically allowed.
7. Fair Usage Policy
- You agree to use Services in compliance with applicable laws and regulations.
- Misuse includes, but is not limited to, unlawful activities, fraud, abusing or promotions, network abuse, excessive or unreasonable data usage, and reselling of Services.
- Lumina reserves the right to suspend or terminate Services in cases of suspected misuse.
8. Roaming and International Use
- Services may include international roaming through Network Partners.
- Availability, speeds, and prices may vary by region, and local restrictions may apply.
9. Refunds and Cancellations
- If you are purchasing the Services as a consumer, you have the legal right to unilaterally withdraw from your purchase within 30 days. This right to withdraw from your purchase expires on the earlier of 30 days after making the purchase, or the date on which the eSIM is activated. Please note that you will not be able to exercise your right of withdrawal for an eSIM that you have already started using.
- Refunds are only available for Services purchased directly from Lumina. If the Services were obtained through a third party, any refund requests must be submitted to that third party. Lumina is not responsible for processing refunds for purchases made via third-party vendors.
- All purchases are generally final and non-refundable unless required by applicable consumer protection law.
- Refunds may be issued at Lumina’s discretion in cases of technical faults, failed activation, or duplicate payments. The following conditions apply:
- You must submit the refund request within thirty (30) days of the issue giving rise to your claim.
- Lumina must be unable to restore your access to, or use of, the purchased Services within 14 days of receiving your refund request.
- You must cooperate fully with our efforts to resolve the issues affecting your access to or use of the Services.
Lumina’s total liability to you, regardless of cause, shall not exceed the amount you paid for the Services in the preceding 30 days.
10. Service Limitations
- Services are provided “as is” and “as available.”
- Lumina does not guarantee uninterrupted, error-free, or secure connectivity.
- Network disruptions, slow speeds, or limited coverage may occur due to third-party carriers or external factors.
11. Privacy and Data Protection
- Lumina collects and processes personal data in accordance with its Privacy Policy.
- Information may be shared with Network Partners and regulatory authorities where legally required.
12. Intellectual Property
- All content, branding, software, and materials related to Lumina Services remain the intellectual property of Lumina or its licensors.
- You receive a limited, non-transferable, revocable right to use the Services for personal purposes only.
13. Suspension and Termination
- Lumina may suspend or terminate Services:
- For breach of these Terms,
- For fraudulent or unlawful use,
- To comply with regulatory or legal requirements.
- Upon termination, any remaining unused data or credits may be forfeited.
14. Liability Disclaimer
- To the maximum extent permitted by law, Lumina disclaims liability for:
- Service interruptions, delays, or failures caused by third parties, networks, or systems outside of our reasonable control,
- Any indirect, incidental, consequential, exemplary, or punitive damages (including lost profits or loss of business opportunities), even if Lumina has been advised of the possibility of such damages,
- Any loss of data, revenue, goodwill, or profits arising from the use or inability to use the Services or Platform,
- The availability, quality, or reliability of underlying connections and networks, which are outside of Lumina’s direct control.
- To the extent that Lumina fails to comply with these Terms, we accept responsibility for your reasonably foreseeable loss and damage. However, in any event, Lumina’s and its affiliates’ total aggregate liability to you shall not exceed the greater of:
- the total amount you paid for the Services in the 30 days prior to the event giving rise to the liability, or
- USD 100.00 (one hundred US dollars).
15. Indemnification
- To the extent permitted by law, you agree to indemnify and hold harmless Lumina, its affiliates, directors, officers, employees, contractors, and Network Partners from and against any claims, demands, damages, liabilities, costs, or expenses (including legal fees) arising out of or relating to:
- your unlawful or improper use of the Services,
- your violation of these Terms, or
- any third‑party legal proceedings, including actions brought by government authorities, caused by or connected to your use of the Services.
16. Changes to Terms
- Lumina may update or amend these Terms from time to time.
- Updated Terms will be posted on our official website or communicated to you. Continued use of the Services constitutes acceptance of the updated Terms.
17. Class Action Waiver
- To the fullest extent permitted by law, all claims and disputes arising under or relating to these Terms or the use of the Services must be brought solely in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.
- ou expressly waive any right to participate in or bring a class action, collective action, or other representative proceeding, whether in court, arbitration, or any other forum.
- No arbitration or other proceeding may be combined with another without the prior written consent of all parties to all affected actions.
- If, despite this waiver, a claim is permitted by law to proceed as a class or representative action, you agree not to participate as a class representative or class member, and any relief shall be limited to individual claims only.
18. Governing Law and Dispute Resolution
- These Terms are governed by the laws of Singapore.
- Any disputes arising out of or relating to the Services shall first be attempted through amicable settlement. If unresolved, disputes shall be submitted to arbitration or courts within Singapore.
